Types of Accidents We Handle

Who Caused You to Become Injured?

Quite possibly the most important question to answer when seeking compensation after an accident is finding out who caused the incident to occur. The at-fault party is called the negligent party, or the party that bears liability. To find out who caused the injury, you must also prove how the injury occurred. In the case of a car crash, law enforcement will typically do a traffic accident investigation, which will most likely reveal the cause of the crash and who should be held liable. However, in the case of a slip and fall in a restaurant, the police may not arrive on the scene to do an investigation. You, along with your attorney, will have to conduct your own investigation through gathering facts and witness accounts to get to the bottom of the fall. Did you fall because the floor was slippery from grease? Or, did you fall because a torn bit of carpet caught your foot? In any personal injury claim or lawsuit, another party must have caused the accident to occur. If you simply fell because you got light-headed, or you crashed your car into a tree because you fell asleep at the wheel, you will not be able to pursue damages from anyone. An experienced personal injury attorney will know where to direct the investigation and how to prove that the at-fault party did, in fact, cause the accident to occur.

Comparative Fault in Georgia

In any personal injury claim in Georgia, you must be able to show that you were less than 50 percent at fault for causing the accident. Whether your injuries were caused in a motorcycle crash or by being bitten by a dog, you cannot be found more than 49 percent at fault for causing the incident, otherwise you will not be able to collect compensation. Moreover, the larger portion of liability that you bear, the less amount of compensation you will be able to receive. For example, if you were bitten by a dog that was on a leash, the owner may be liable for only 60 percent of the accident if you somehow provoked the dog by taunting it. If you were 40 percent at fault, you would only be able to collect 60 percent of the damages available.

We pride ourselves in providing legal assistance for people who are injured in a variety of ways.  We often take cases for people who have been injured in the following types of accidents:

  • Car and Auto Accidents

In 2015, there were over 19,000 serious traffic injuries in Georgia, and the rate of serious injury per 100 million vehicle miles driven was 16.5, according to the Georgia Governor’s Office of Highway Safety. What this shows is that your daily commute is most likely the most dangerous activity that you do on any given day. Often, traffic collisions leave innocent victims with tens or even hundreds of thousands of dollars of medical bills and other costs.

  • Truck Accidents

If you were involved in a truck accident, you need to enlist the help of an attorney who has experience delivering big results when up against large insurance companies that do not want to pay out. Collisions with trucks are often very severe, and the insurance policies are usually very large to match. However, few insurance carriers will max out on a policy without a lot of pressure from an experienced law firm.

  • DUI Accidents

Sadly, DUI drivers have been wreaking havoc in Georgia. According to the National Highway Traffic Safety Administration, the number of alcohol-impaired-deaths in the state increased by 31 percent in just one year.

  • Premises Liability

All business owners and property owners have a duty to keep their premises safe for all invitees. When they fail to do so, and someone gets injured, they must be held liable.

  • Pedestrian and Bicyclist Accidents

Due to the prevalence of driver cell phone use, pedestrians and cyclists have been getting hit in greater and greater numbers. Just as worse, drivers tend to blame the pedestrian or cyclists for getting hit, and bias in law enforcement and throughout society does not help an injured pedestrian’s chances of receiving compensation.

  • Wrongful Death

When a person dies due to another’s careless or reckless actions, the family members of the deceased may suffer serious financial and emotional difficulties. The financial losses can be compensated through a wrongful death claim or lawsuit.

  • Motorcycle Accidents

Just because motorcyclists are “hard to see” does not give a car or truck driver free reign to hit them without suffering serious consequences. We hold negligent drivers accountable for causing pain and suffering to our clients.

  • Uninsured Motorist Accidents

Unfortunately, while illegal, many drivers still do not have car insurance, or they have too little coverage to pay for your damages. We find other ways to ensure that you get paid for your injuries.

  • Work or Workplace-Related Accidents and Injuries

If you were hurt on the job or got sick from workplace exposures, you deserve workers’ compensation benefits. These are harder to procure than you might think, and an attorney will go a long way in ensuring that you are not mistreated by your employer or insurance carrier during your recovery process.
