What to Do After an Auto Accident in Rockdale County

Causes of Bicycle Accidents

There are many reasons why cyclists might get into an accident. Some of the more common include:

  • Cyclist error. A cyclist might be riding in a careless or aggressive fashion. Some cyclists like to weave in and out of traffic and as a result can crash into a vehicle.
  • Driver error. The driver of a motor vehicle could crash into a cyclist. There are many reasons why this happens. Some drivers are very aggressive and do not want to share the road with a cyclist. Others are simply negligent and fail to see a cyclist before hitting them.
  • Road defects. Potholes, debris, and other defects can upend a cyclist, who are much more vulnerable to road defects than drivers of motor vehicles.
  • Defective bicycle. Malfunctioning brakes, pedals, and other parts can cause a cyclist to lose control, leading to a crash.

Bicycle Accident Injuries

Cyclists are much more exposed than occupants of a motor vehicle. As a result, they can suffer more devastating injuries, including:

  • Traumatic brain injuries
  • Fractures
  • Nerve damage
  • Road rash
  • Back injuries
  • Spinal cord damage
  • Death

If you have suffered a serious injury, make sure to get prompt medical attention, which can often make the difference between a speedy recovery and months of pain and disability.

Receiving Compensation for Your Injuries

If someone else is partially responsible for the crash, you might be able to sue them or make a claim on their insurance policy. For example, an injured victim could make a claim on a negligent motorist’s liability insurance if they are injured in a crash. If a defective part caused the collision, they should make a claim with the manufacturer.

Compensation can cover a variety of financial losses, such as medical care required to treat the injuries and lost wages. Our clients sometimes also qualify for money to cover property damage, such as damage to the bike.

Depending on your injuries, you might also receive damages for pain and suffering and/or emotional distress. Serious injuries leave cyclists in considerable pain, which can lead to depression, anxiety, anger, sleeplessness, and irritability. All of this suffering deserves compensation.

What to Do after a Bicycle Accident

Receiving compensation will depend on showing that someone else’s negligent conduct caused your injuries. To that end, we recommend that injured cyclists do as much of the following as they can, given their physical disabilities:

  • Take pictures of all vehicles involved in the crash. You can use your smartphone or borrow someone else’s. Try to get a picture of where the vehicle made contact with your bike.
  • Identify witnesses to the accident. Ask for their name and contact information.
  • Call the police to come out to the accident if another vehicle hit you. An officer should write a police report, which many insurers want to see.
  • Receive prompt medical attention for your injuries and follow your doctor’s orders for getting well.
  • Preserve your bicycle. Don’t fix it or throw it away until a lawyer has analyzed it. Your bicycle might contain some important clues about who is to blame. If your bicycle was defective, then we will want to preserve the defective part.

Also never admit fault for the crash or agree to any sort of settlement without first meeting with an attorney. Insurance companies sometimes try to settle these cases quickly by getting injured victims to sign a settlement agreement without really understanding the true value of their claim.
