Our Experience: Client Struck Crossing the Road
In November 2024, our client was hit by a pick-up truck while crossing the road at Smyrna Road and Old Covington Highway in Rockdale County, Georgia. There were no cross walks or sidewalks in that part of Conyers. The at-fault driver admitted to swerving to avoid a pothole and failing to maintain his lane, forcefully striking our client.
Our client sustained critical injuries, including a fractured hip and pelvis, a concussion, and scalp laceration. Her injuries were so severe that she was hospitalized for four days at Piedmont Athens Regional Hospital. MG Law investigated the incident, reviewing the layout of the road, bodycam footage, and our client’s medical records. We ultimately secured a $250,000.00 settlement with the at fault driver’s insurance company.
Our Experience: Client Struck in a Crosswalk
Our client hit by a car while crossing the street in a crosswalk over Ivy Street in Covington, Georgia. The at-fault driver was cited by police for failing to yield to a pedestrian in a crosswalk. That driver admitted he never saw our client enter the crosswalk and only noticed him after impact.
Our client suffered serious injuries, including a broken collarbone, and was rushed to Piedmont Newton Hospital. That injury required surgery to insert screws and a plate onto his clavicle fracture. Even after that surgery, our client experienced pain in his shoulder and chest and struggled with everyday tasks like lifting objects and working at a computer.
MG Law investigated the incident and discovered evidence that the driver was distracted by his cell phone at the time of the crash. Our law firm secured a $175,000.00 settlement with the at fault driver’s insurance company.
Understanding Pedestrian Rights in Georgia
Georgia law specifically requires drivers to exercise due care to avoid hitting pedestrians. O.C.G.A. § 40-6-93. When a pedestrian is in a crosswalk, Georgia law requires that a driver must stop and remain stopped for the pedestrian, even if the driver is turning or the light is green. Other drivers approaching a vehicle stopped for a pedestrian may not pass that stopped vehicle. O.C.G.A. § 40-6-91.
